Isolating The Judge in Islamic Jurisprudence and Its Applications in the Law of The Formation of The Islamic Courts Jordanian Landmarks

Abstract | الملخص

This study aims to release the concept of isolating the judge, and to clarify its causes in the light of Islamic jurisprudence, and the mention of its applications in the law of the formation of the Islamic courts of Jordan, has followed the researcher to achieve these things inductive approach fundamentalist, and that extrapolating with respect to the removal of the judge of the Islamic jurisprudence, and rooting him according to Islamic law. The study found a set of results is the most important: There are a lot of reasons that relate to the person of the judge to be isolated; for example isolating him self same reasons with certain excuse, and exposure to certain symptoms, and change state to immorality and injustice, and committing to some disadvantages of ethics such as taking bribes and not amended, and lack of commitment to the mandate. And the most important applications statement isolating the judge in the law of the formation of the Jordanian Sharia courts, and being disabled judges to isolate and taking into account the jurisdiction, and asking the judge to resign, and to allocate to retirement, these things have been confirmed through the articles of the law.
