The Criminal Protection of The Right of Privacy of Telephone Calls (Study in Kuwait and UAE Laws)


Abstract | الملخص

This paper deals with a very important topic, what is the right to the privacy of calls and telephone conversations facing of the challenges imposed by the emerging developments in recent times, both with respect to the technical development in the field of communications and eavesdropping devices, surveillance technology, including with regard to the challenges of national security and the right of every state to protect its internally national security or externally, So the criminal legislature in the various countries of the world put the criminal provisions that guarantee not to prejudice the national security, in the field of telecommunications, mobiles, and we found the Criminal legislator put the criminal provisions that ensured guarantees individual's enjoyment of their right to Privacy for making calls and telephone conversations, to achieve the balance between the protection of society, whether in the form of prompt justice, and the right of individuals to privacy. So this research came in three main sections, the first deals with definition of the right to the privacy of calls and telephone, the second deals with the criminal protection objective of the right to the privacy of calls or telephone conversations, and finally the third section of criminal protection procedural right to the privacy of calls or telephone conversations, Finally, the research ends to several of results and recommendation.
