Medical Error in the Jordanian Civil Code


Abstract | الملخص

This study deals with an important topic on both theory and practice in the field of civil liability for medical error. Medical error, but put responsibility for the general rules governing the tort and the damage and the causal relationship, so there are no specific rules governing civil liability doctor. The aim of this study was to know the suitability of the application of the general of civil liability in the case of medical error. It was found that medical error is subject to the standard year in determining the error in civil liability, but the specific nature of the technical work involved in the medical and raises the question of seriousness about the concept of medical error and its standard and manifestations and effects. The study recommends Jordanian legislators need to enact a special law to accountability, medical doctors and that the necessary insurance of civil responsibility toward their patients.
